Succession and Family

Context:

Alburquerque assisted its clients with due diligence and partition agreements throughout the process that included three unified successions that, with our mediation and solutions at the time of conflicts, allowed a friendly partition, with respect to more than forty properties, share certificates and other movable property both nationally and abroad. Agreements which were duly approved before the civil court specialized in Family matters with the obtaining of the corresponding Judgment that ordered the Determination of Heirs, prior to the Formation of a Family Council of a minor, and compliance with all the tax procedures of the place, until obtaining the Certificates of Titles authorized directly to be issued by the Registrar of Titles of the places of each property and the authorization to recover the movable property.

As a result of the assistance and consultancy provided by our firm, we successfully carried out the request of our clients to complete the whole process of distribution of such assets that made up the existing estate.

Context:

Alburquerque assisted the client, after finding out about an unknown Divorce sponsored by the client’s husband, with the purpose of separating her from her patrimony. After obtaining the elements of proof that justified our action, we obtained the final judgment that declared the Nullity of the Divorce and ordered the Civil Status Officer to nullify the act of pronouncement of the Divorce. On the other hand, the litigious partition of the matrimonial community by the husband was sued.

Benefit:

As a result of the assistance and consultancy provided by our firm, an amicable settlement agreement was finally signed and with it, the dismissal of the legal actions invoked, and the lifting of the annotations registered on the property. Consequently, the agreements and contracts that led to the sale of the Real Estate and the distribution of the revenues obtained therefrom were signed.

Context:

The client was the beneficiary of a property bequeathed by his deceased brother. In this sense, Alburquerque assisted the Client filing the documents for Determination of Heirs via Testamentary of the real estate, obtained the Judgment that homologates said Will and declares the client as the only person with quality to receive the relict property of his brother, among other indications, before the competent court of law.

Subsequently, this beneficiary also passed away and his wife remained as beneficiary of the Universal Will; however, a third person managed to transfer the property in an illegal manner, whereupon we assisted in the litigious process until obtaining the final Judgment that declared null and void the Act of Sale with which it was intended to justify the ownership of the property, thereby cancelling the Certificate of Title, and by effect of the decision, the property rights were transferred to the beneficiary.
Benefit:

According to the due process, we were able to exhaust the procedure for the determination of heirs and payment of taxes, obtaining the Certificate of Titles in favor of the surviving spouse.
