Foreign Investment and International Trade

Context:

The client was a multinational corporate group with a relevant airline within the European and Latin-American market.

Alburquerque assisted the client by representing it before de Conciliation and Arbitration Council of the Chamber of Commerce and Production of Santo Domingo in a conciliation process executed by the parties regarding the client´s request to terminate de Agency Contract with exclusivity, which was held by the counterpart and duly registered before de Central Bank of the Dominican Republic complying with Law No. 173 on Merchandise and products importing agents. As a result, we were able to accomplish an agreement leading to the termination of said contract, in accordance with the client´s interests.

Benefit:

Due to the conciliation process developed by the firm, the client benefited from a negotiation on which he was not obliged to pay all the compensation established by law, such as losses, investment, and profits obtained by the client. Instead, the parties agreed on a compensation which only included the value created on the domestic market for services and products. Therefore, this transaction resulted in significant savings for our client, amounting to USD$130,000.00.
